Accused Nos.1 and 2 in Crime No.75/2026 registered by Dobbespet Police Station, Bengaluru District, for the offence punishable under Section 309(4) of BNS, 2023, are before this Court in this petition filed under Section 483 of the BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.75/2026 was registered by Dobbespet Police Station, Bengaluru District, for the aforesaid offence against two unknown persons based on first information dated 26.04.2026 received from Darshan Yadav S/o. Devaraju. In the said case, petitioners herein were arrested on 29.04.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR CNR: KAHC010393592026 NC: 2026:KHC:36187 CRL.P No. 8305 of 2026 Crl.Misc.No.944/2026 was rejected on 22.05.2026 and therefore, they are before this Court. 4. Perusal of the material on record would go to show that first information was submitted by the alleged victim on 26.04.2026 at about 18.30 hours. In the typed first information, he has stated that his father Devaraju had taken the contract to supply dairy milk. He and his relative Shashank were assisting his father in his business. On 26.04.2026, when the first informant and his relative Shashank were traveling in their vehicle bearing registration No.KA-13-B-0601, Shashank allegedly asked to stop the vehicle to enable him to attend nature call. When the vehicle was stopped, two unknown persons who came in a motorbike, allegedly snatched the bag which the first informant was carrying and escaped. Alleging that the bag which the two accused persons snatched contained a sum of Rs.1,35,600/-, the first informant had approached the police. 5. During the course of investigation, three persons were arrested in the present case and charge sheet has been - 4 - HC-KAR CNR: KAHC010393592026 NC: 2026:KHC:36187 CRL.P No. 8305 of 2026 filed against them. Allegation in the charge sheet is that accused No.1 - Shashank is the mastermind of the crime and at his instance, accused No.2 and 3 had snatched the bag containing money on 26.04.2026 from the vehicle in which accused No.1 - Shashank and first informant were traveling. It is not in dispute that petitioners have no other criminal antecedents. Investigation of the case is completed and charge sheet has been filed. Maximum punishment for the alleged offence is imprisonment for a period of 10 years. Under the circumstances, I am of the opinion that the petitioners' prayer for grant of regular bail, needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: 6. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.75/2026 registered by Dobbespet Police Station, Bengaluru District, for the offence punishable under Section 309(4) of BNS, 2023, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the - 5 - HC-KAR CNR: KAHC010393592026 NC: 2026:KHC:36187 CRL.P No. 8305 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
