Learned advocate appearing for the petitioner submits that the petitioner has been implicated only on the foundation that the petitioner happens to be a family member of a political personality of the locality. The accusations against the petitioner relate to incidence complained of from the year 2019. There are accusations for collecting money from different persons. Learned advocate for the petitioner submits that the said accusations are not substantiated and the petitioner has been victimized. On the other hand, learned advocate for the State opposes the prayer for anticipatory bail and submits that the statement of the witnesses who have repeatedly stated regarding the
2 petitioner’s complicity for extorting amounts for different purposes. It has also been pointed out that from the bank statement of the present petitioner a sum of Rs.25 lakhs have been found although the petitioner do not have a specific employment. I have taken into account the overall circumstances particularly the nature of accusations which primarily fallen to the father of the present accused and the petitioner’s role was in aiding his father who is an Ex-MLA and Ex-Chairman of Kalna Municipality. Having considered the overall circumstances of the case and the fact that the account of the petitioner has been frozen in course of the investigation, I am of the opinion that custodial detention may not be warranted in the facts of the case so far as the present petitioner is concerned. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Kunal Bag shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Additionally, petitioner will make himself available before the investing officer of the case as and when called for and will leave the district of Purba Bardhaman only with the permission of the learned ACJM, Kalna. With the aforesaid observations, CRM(A)1967 of 2026 is
3 allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
