(2) Since common questions of fact and law are involved in these writ petitions, therefore, these are being heard and decided together by this common judgment and order. However, for brevity, facts of WPSS No. 678 of 2026 alone are being considered and discussed here. (3) Petitioner was appointed as Shiksha Mitra in a Primary School in District Haridwar in 2011. According to him, he has qualified Teachers Eligibility Test and he also possesses Diploma in Elementary Education (D.El.Ed.) from NIOS, therefore he is entitled for regular appointment as Assistant Teacher in a Government Primary School. He relies upon a Government Order dated 16.8.2019, which provides that Shiksha Mitra, who possesses necessary conditions of eligibility for appointment as Assistant Teacher, may be considered for regular appointment. (4) Learned State Counsel, however, submits that petitioner has passed CTET conducted by Central Board of Secondary Education, which is meant for appointment only in the schools run by Kendriya Vidyalaya Sangathan or the schools within National Capital Territory of Delhi. He submits that CTET-I cleared by petitioner does not entitle him for appointment under State of Uttarakhand. He further submits that if petitioner has any grievance against his non- 2026:UHC:1788 consideration for his regular appointment, he can approach the competent authority by making a representation. (5) Writ petitions are, accordingly, disposed of granting liberty to petitioners to make representation to competent authority. If petitioners make representation within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter.
