Learned counsel for the petitioner submits that the only material available against the petitioner is a statement of a co-accused.
Learned counsel for the State strongly opposes the prayer for anticipatory bail and submits that other than the statement of a co-accused, there are several phone calls made between the petitioner and the principal accused at the relevant time. Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected.
