JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Rahul Pandey, Advocate For the State : Mr. Rajesh Kumar, Addl.P.P For the Informant : Mr. Atulaya Shresth : Ms. Prakriti Prerna, Advocate ------ Order No.02 Dated- 08-10-2026 Heard the parties. The petitioner has been made accused in connection with Argora P.S. Case No. 176 of 2026 registered for the offences punishable under Sections 331(2), 329(4), 324(4) & 3(5) of the BNS, 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner impersonated himself as the son of Matavar Ram and fraudulently transferred the disputed land in favour of his wife. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has created the document to show that the informant is not the daughter of the Matavar Ram, hence, such contention of the petitioner was found to be false during the investigation of the case. Drawing attention of this Court to the Judgement dated 08.09.2025 passed in Complaint Case No.431 of 2018 in which case, the informant of this case was also the complainant and the informant herein who was the complainant in that case claimed in that case that the petitioner is a maternal brother and the wife of the petitioner- Ritu Kumari used to reside with the complainant/informant and her father prior to her marriage with the petitioner and in that case also, the complainant claimed that the petitioner herein falsely represented himself to be the son of Matavar Ram and executed the deed of transfer in favour of his wife Ritu Kumari but the learned Judicial Magistrate-1st Class, Ranchi considering the evidence in the record, acquitted the petitioner and his wife from all the charges and the Criminal Appeal No.31 of 2026 filed by the informant against the said judgement of acquittal, has been dismissed vide judgment dated 17.06.2026 passed by the learned Additional Judicial Commissioner-V, Ranchi. It is further submitted that the dispute between the parties at best a civil dispute. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para-19 of this bail application; as the sole case which was pending against the petitioner has ended up in his acquittal and the appeal has been dismissed. It is further submitted that the petitioner has been in custody since 18.08.2026 as mentioned in para-01 of the instant bail application. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned counsel appearing for the State and the learned counsel for the informant on the other hand vehemently opposes the prayer for bail of the petitioner and submit that the service book of Matavar Ram shows that the informant is his daughter, hence, the petitioner ought not be admitted to bail. Considering the facts of this case and the dispute between the parties is basically a civil dispute regarding succession and the petitioner has already been acquitted of similar allegations vide the judgment passed in Complaint Case No.431 of 2018 and the criminal appeal has been dismissed, hence, this Court is of the considered view that this is a fit case where the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned JMFC, Ranchi in connection with Argora P.S. Case No. 176 of 2026 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. 08/10/2026-Abhiraj/ (Anil Kumar Choudhary, J.)
