The claimant, being dissatisfied with the compensation of Rs.3,59,806/- awarded by the Tribunal, is in appeal. 2. The fact that the accident occurred and the further fact that the offending vehicle was insured is not in dispute. 3. Loss of income due to permanent disability 2,82,240 Total 3,59,806 4. The sums awarded by the Tribunal towards 'loss of future income' and 'conveyance, attendant charges & food and nourishment expenses', being just and proper, are affirmed. 5. The sum awarded as medical expenses at Rs.28,566/- being based on the documentary evidence, do not call for modification and hence confirmed. 6. Having regard to the injuries suffered by the claimant and the treatment taken for the same, I deem it just and appropriate to award a sum of Rs.50,000/- towards 'pain and suffering' as against Rs.15,000/- and a sum of Rs.42,000/- towards 'loss of income during the laid up period' as against sum of Rs.28,000/- awarded by the Tribunal. 7. Having regard to the lasting effect of injuries suffered by the claimant, I deem it just and appropriate to award a sum of Rs.40,000/- towards 'loss of amenities'. - 4 - HC-KAR NC: 2026:KHC:35842 MFA No. 8452 of 2022 8.
