Mr. Rajendra Banerjee, Ld. APP Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner surrendered on November, 2025 and since then he is in custody. Other accused persons have been granted bail and till date out of 43 witnesses 11 witnesses have been examined. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of the witnesses including the statement under Section 164 Cr.P.C. of one of the witnesses. I have taken into account the locus of the other accused as well as the present petitioner and without entering into the merits of the case, for the time being, I am not inclined to release the petitioner on bail as the other accused persons were arrested on a 2 different point of time and petitioner initially was evading the process of law for a considerable period of time. Consequently, at this stage CRM (M) 1197 of 2026 is dismissed. Petitioner would renew his prayer for bail after the evidence of vulnerable witnesses are over. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
