Petitioner had approached this Court by filing WPSS No. 3391 of 2018, which was disposed of with a direction to the Competent Authority to take decision on the representation made by petitioner for his regularisation. Pursuant to the order passed in that writ petition, Chief Executive Officer, Uttarakhand Live Stock Development Board has passed an order on 31.01.2019, providing that cadre structure of Uttarakhand Live Stock Development Board is yet to be sanctioned, therefore, it is not possible to regularise the services of the petitioner on the post of Driver. 5. The reason assigned by Chief Executive Officer in the impugned order cannot be faulted, unless the cadre structure of the employer is sanctioned, there can’t be any direction for regularisation of the petitioner. Reportedly, the Chief Executive Officer has recommended to the State Government to sanction cadre structure of Uttarakhand Live Stock Development Board. 2026:UHC:1872 6. The writ petition is, accordingly, disposed of by directing the Secretary, Animal Husbandry, Government of Uttarakhand to consider the proposal submitted by Chief Executive Officer and pass appropriate order, as per law, within six weeks from the date of presentation of certified copy of this order. Petitioner’s claim for regularisation shall be considered once the cadre structure is sanctioned.
