JUSTICE P SREE SUDHA ORAL JUDGMENT Tribunal had passed a common award in MVC No.2432/2022 c/w MVC No.2433/2022. This appeal is filed by the appellant/claimant under Section 173(1) of Motor Vehicles Act, 1988 challenging the judgment and award dated 08.11.2023 passed in MVC No.2432/2022 on the file of the XVII Additional Judge, Court Of Small Causes, and Member, MACT, Mayo Hall Unit, Bengaluru, for enhancing the compensation. 2. Heard the arguments of the learned counsel for the appellant and learned counsel for respondent No.1. The ranks of the parties are retained as per tribunal for the sake of convenience. - 3 - HC-KAR NC: 2026:KHC:18487 MFA No. 4095 of 2024 3. Injured claimant met with an accident on 04.04.2022 and filed claim petition claiming compensation of Rs.10,00,000/-. The Tribunal considering the entire evidence on record granted global compensation which included pain and suffering, loss of income during laid up period, conveyance, attendant and incidental expenses of Rs.50,000/- along with interest at the rate of 6% p.a., from the date of petition till the date of realization. 4. Aggrieved by the said order, he preferred an appeal and mainly contended that the Tribunal has not granted any amount under the other heads and the interest is to be granted at the rate of 12%. Further submits that he incurred Rs.2,00,000/- towards medical expenses, but the Tribunal granted Rs.11,442/-. The injured was inpatient for 2 days and thus requested for enhancement of the total compensation. 5. It is further stated that as per Ex.P5/wound certificate the petitioner sustained (1) Multiple abrasion over the face, and (2) Abrasion present below left knee - 4 - HC-KAR NC: 2026:KHC:18487 MFA No. 4095 of 2024 and the injuries were simple in nature. Petitioner has not examined the doctor, but he filed medical bills under Ex.P9 to an extent of Rs.11,442/- and prescriptions are filed under Ex.P10. It is stated that he was aged 32 years working as an employee in Flow Tech Company and was earning Rs.20,000/- per month, but he has not filed any income proof. 6. The Tribunal observed that he might not have worked at least for a period of 15 days and granted global compensation of Rs.50,000/- including the medical expenses and other heads. Therefore, this court finds no reason to interfere with the said order. In the result, appeal is dismissed as devoid of merits by confirming the award of the Tribunal.
