This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.137/2025, registered at Police Outpost- Chikali, PS- Kotwali, District- Rajnandgaon (CG) VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.22 17:02:51 +0530
2 for the offence punishable under Sections 137(2), 64(2)(m), 87 of BNS and Sections 5(L), 6 of POCSO Act. 2. The prosecution case, in brief, is that on 19.03.2025, the victim's mother lodged a missing report stating that the victim had gone to her maternal grandmother's house with her maternal uncle on 18.03.2025 and went missing from there on 19.03.2025. During investigation, it was found that the applicant had abducted the victim and taken her to Hyderabad. The victim was recovered from the applicant's custody on 27.03.2025. The applicant was arrested, and after completion of the investigation, the charge- sheet was filed before the competent Court. 3. Learned counsel for the applicant contended that the applicant has not committed any offence and has been falsely implicated in the said case. He further contended that at the time of alleged incident, age of the victim was 17-19 years and the applicant and the victim were acquainted with each other. Learned counsel further contended that the applicant is in jail since 27.03.2025, and the trial will take considerable time for its conclusion, therefore, the applicant may be released on bail. 4.
Learned State counsel opposes the submission made by learned counsel for the applicant and would submit that at the time of incident, age of the victim was below 18 years and the victim has
3 specifically stated in her Court statement about her date of birth and as per her statement, the applicant has committed repeatedly sexual intercourse with her, therefore, the applicant may not be released on bail. 5. Pursuant to order dated 29.06.2026, victim and her mother appeared before this Court through virtual mode from the DLSA- Rajnandgaon (C.G.). On being asked, they have no objection for grant of bail to the applicant. Their statements are taken on record. 6. I have heard learned counsel for the parties. 7. Considering the facts and circumstances of the case and further considering the material available on record, this Court is not inclined to grant bail to the applicant. 8. Accordingly, the bail application of the applicant stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for information.
