JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 to 3 in Crime No.65/2026 registered by Rajanukunte Police Station for the offences punishable under Sections 109, 115(2), 352, 351(2), 351(3) read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Section 25 of the Indian Arms Act, 1959 are before - 3 - HC-KAR NC: 2026:KHC:35286 CRL.P No. 7878 of 2026 this Court in this petition filed under Section 483 of Bharathiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.65/2026 was registered by Rajanukunte Police Station for the aforesaid offences against two unknown persons based on the first information dated 14.03.2026 received from the victim - Mohammed Mukthar. During the course of investigation, accused No.1 was arrested on 30.03.2026, accused No.2 was arrested on 15.03.2026 and accused No.3 was arrested on 27.03.2026. After completing investigation, charge sheet has been now filed against three persons and the petitioners herein are arrayed as accused Nos.1 to 3. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.10112/2026 was rejected on 27.05.2026. In the first information dated 14.03.2026, it is stated that accused persons, who came to the hotel, where the first informant was working as a cook-cum- cashier on 14.03.2026, allegedly had quarreled with him for the reason that he had asked them to pay money even before biriyani was served to them. In the incident in question, the victims have not suffered any injuries. In the first information, it is alleged that after abusing the first informant and another, who was along with him in the hotel, the accused persons threw away the biriyani and other food that had been prepared in the hotel. It is not in dispute that the petitioners do not have any criminal antecedents. Investigation of the case is now completed and charge sheet has been filed. Under these circumstances, the prayer for grant of regular bail needs to be answered in the affirmative. Accordingly, the following; ORDER (i) The Criminal Petition is allowed. - 5 - HC-KAR NC: 2026:KHC:35286 CRL.P No. 7878 of 2026 (ii) The petitioners are directed to be enlarged on bail in Crime No.65/2026 registered by Rajanukunte Police Station for the offences punishable under Sections 109, 115(2), 352, 351(2), 351(3) read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 and Section 25 of the Indian Arms Act, 1959, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) Petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioners shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:35286 CRL.P No. 7878 of 2026 e) Petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
