It transpires from the record that the applicant is in jail since 08.01.2026. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN 2 counsel. 3. This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 06/2026 registered at Police Station Bilaligarh, District Sarangarh, Bilaigarh (C.G.) for the offence punishable under Sections 109(1), 118(1), 126(2), 191(2), 191(3), 190 and 61(2) of the BNS. 4. Case of the prosecution, in brief, is that the complainant, Puleshwar Verma, had earlier lodged a complaint against the village Sarpanch, on account of which the accused persons allegedly developed enmity against him. On 03.01.2026, the applicant, along with the co-accused persons, is alleged to have intercepted the complainant and, during an altercation relating to the said complaint, assaulted him, wherein the applicant allegedly inflicted knife injuries on the complainant's left shoulder and abdomen. It is further alleged that when the complainant, accompanied by his father, Maniram Verma, and elder uncle, Shobhit Ram Verma, was proceeding to the police station to lodge a report, the accused persons again intercepted them, abused them in filthy language, and, in furtherance of their common intention, assaulted them with sticks, iron rods and stones, causing grievous and life-threatening injuries to Maniram Verma and Shobhit Ram Verma. During investigation, the injured persons were medically examined, and upon completion of the 3 investigation, the charge-sheet was filed against the applicant before the competent Court. Hence, the bail application. 5. It transpires from the averments made in the present bail application that the sole ground urged by the applicant in support of this second bail application is that the applicant has been in judicial custody since 08.01.2026. 6. Learned State counsel opposes the bail application and submits the applicant allegedly in connivance with the co-accused persons, assaulted the complainant due to previous enmity arising out of a complaint made against the village Sarpanch, and inflicted knife injuries on the complainant's left shoulder and abdomen. It is further alleged that the applicant, in furtherance of the common intention of the co-accused, again intercepted the complainant and his family members while they were proceeding to the police station and participated in the assault with deadly weapons, resulting in grievous and life-threatening injuries to two of the injured persons. Therefore, the applicant is not entitled for grant of bail. 7. I have perused the material available on record. 8. From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected by this Court vide order dated 27.04.2026 in MCRC No. 3793 of 2026 on the ground that the material available on record prima facie disclosed his active and specific 4 role in the commission of the offence, as he is alleged to have inflicted knife injuries on vital parts of the complainant's body, while the other injured persons sustained grievous and life- threatening injuries, looking to the seriousness of the offence, the medical evidence, and the fact that the applicant's role was distinguishable from that of the co-accused who were granted bail, as they were alleged to have used only hands and sticks whereas the present applicant allegedly used a deadly weapon, i.e. a knife. So far as the status of trial is concerned, no order-sheet of the trial Court has been filed along with the bail application. Considering the fact that the first bail application of the applicant was rejected on merits, there appears to be no good ground to entertain the present second bail application of the applicant. 9. Accordingly, the second bail application of the applicant- Sahettar Sahu, involved in Crime No. 06/2026 registered at Police Station Bilaligarh, District Sarangarh, Bilaigarh (C.G.) for the offence punishable under Sections 109(1), 118(1), 126(2), 191(2), 191(3), 190 and 61(2) of the BNS, is rejected at this stage. 10.Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 11.Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance.
