This is the 2nd bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No.176/2024 registered at Police Station – Torwa, Bilaspur (C.G.), for the offence under Section 20(b)(ii)(C) of SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.07.22 11:28:21 +0530
2 NDPS Act. Earlier application has been rejected on merits vide order dated 02.07.2025 passed in M.Cr.C No.5082/2025.

Briefly stated, the facts of the case are that on 05.05.2024, Police Station Torwa received a secret information that two persons residing as tenants in the house of Sushant Mali at Kashyap Bada, Devridih, were illegally storing a large quantity of ganja for the purpose of sale. Acting upon the said information, the police conducted a raid at the premises and apprehended two persons, who disclosed their names as the present Applicant and Subrat Mihir. Upon search of their respective rooms, ganja packed in plastic sacks was allegedly recovered. The seized contraband was identified as ganja in the presence of witnesses and after weighment, 28 kilograms of ganja was recovered from the possession of the Applicant and 24 kilograms from the possession of Subrat Mihir, aggregating to 52 kilograms. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is further submitted that out of the 19 prosecution witnesses, only 7 have been examined so far. It is also submitted that the Applicant has been in judicial custody
3 since 05.05.2024 and as the trial is likely to take considerable time for its conclusion, he may be enlarged on regular bail.
4. On the other hand, learned State Counsel opposes the bail application and submits that the alleged recovery is of commercial quantity. It is further submitted that the Special Leave Petition (Criminal) Diary No.60390/2025 preferred against the order dated 02.07.2025 passed by this Court in MCRC No.5082/2025 has also been dismissed by the Hon'ble Supreme Court vide order dated 27.11.2025, therefore, it is prayed that the present bail application may be rejected.

Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature and gravity of the allegations, the fact that 52 kilograms of ganja, which is commercial quantity, was allegedly recovered from the possession of the present Applicant, further considering that the earlier order of this Court declining bail has been carried before the Hon'ble Supreme Court and the Special Leave Petition (Criminal) Diary No.60390/2025 has also been dismissed vide order dated 27.11.2025 and there being no substantial change in the circumstances so as to warrant reconsideration of the prayer for bail and without further commenting anything on
4 the merits of the case, this Court is not inclined to extend the benefit of regular bail to the present Applicant.
6. Accordingly, the bail application of the applicant – Amit Kumar Singh involved in Crime No. 176/2024 registered at Police Station – Torwa, Bilaspur (C.G.), for the offence under Section 20(b)(ii)(C) of NDPS Act is hereby rejected.
