The Court :- Appeal is at the behest of persons claiming to be former employees of a company and directed against order dated January 20, 2026 passed in an Originating Summons Suit being CSOS/5/2024. Learned advocate appearing for the appellant submits that, the Appeal Court, by an order dated June 9, 2026 passed in APO/5/2026, added the employees of the company as parties to the pending originating summons suit proceeding. He submits that, similar relief may be extended to the appellant. Learned senior advocate appearing for the plaintiff in the suit, on instruction, submits that, although the appellants stand in a different footing 2 than that of the appellants in APO/5/2026, nonetheless the plaintiff is not object to the appellants being added as a party to the pending originating summons suit and being heard by such Court. The appellants before us, as former employees, claim that they are entitled to benefits under a trust created in respect of employees of a company. We hasten to add that we are not deciding the respective claims of the parties in this regard. Simply on the ground that the appellants need to be heard by the Court deciding the pending originating summons suit in view of the claims made by the appellants before us as former employees who claim to be entitled to the benefits under the trust of the company, we extend the facility as extended to the appellants in APO/5/2026. The appellants before us are, therefore, added as party respondents in the pending originating summons suit. The plaintiffs in the originating summons suit will take appropriate steps to include the appellants before us as respondents in such proceedings. Failure to do so by the appellants will permit the appellants to take out appropriate application for amendment before the learned Single Judge.
