Mr. Rajendra Banerjee Ms. Nayana Mukhopadhyay. …for the State. Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Ms. Nayana Mukhopadhyay, learned advocate, appears on behalf of the State. Their Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 10 months and there has been alleged recovery of 2966 ampoules of Buprenorphine injections. Earlier, there was a direction to complete the evidence of the seizure list witnesses. However, till date the evidence of such witnesses could not be completed. Learned advocate for the State, on the other hand, 2 submits that the recovery was from the present petitioner and date for recording of evidence has been fixed on 19th August, 2026. At this stage, I am not inclined to release the petitioner on bail. Learned trial court is directed that if after the evidence of the independent seizure list witnesses are completed, which should be completed within a period of three months there is change in the prosecution case, learned trial court would on an application filed by the petitioner release the petitioner on bail. With the aforesaid observations, CRM(NDPS)968 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
