THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs; (a) Issue a writ of mandamus directing the respondent to consider the representation dated 07.05.2024 and 27.05.2024 vide Annexure-F and Annexure-F1. (b) Issue a writ of mandamus directing the respondent to alternatively allot any other equivalent worth in favour of petitioner. (c) Issue any other writ, order or direction and such other reliefs as this Hon'ble Court may deems fit to grant in the facts and - 3 - HC-KAR NC: 2026:KHC:35145 WP No. 16985 of 2025 circumstances of the case, in the interest of justice and equity. 2. The petitioner is a proprietary concern whose proprietrix is a woman belonging to the Scheduled Caste category. With an intention to set up an industrial unit, she had made an application to respondent no.2 on 24.03.2023 at Annexure-E, in pursuance of the preliminary approval of the Industries and Commerce Department dated 20.10.2022. The said application not being considered, the petitioner had submitted representations on 07.5.2024 and 27.05.2024 at Annexures-F and F1 respectively. 3. The grievance of the petitioner is that neither the application nor the representations have been considered by the respondents till date. When an application or a representation is submitted, it is required for the respondent KIADB to have considered the same and passed necessary orders either accepting or rejecting the application made. Needless to say, if an order of rejection was to be passed, it would be required to be accompanied - 4 - HC-KAR NC: 2026:KHC:35145 WP No. 16985 of 2025 by reasons. Neither having been made, this Court passes the following order; 4. (i) Writ petition allowed. (ii) A mandamus is issued directing the respondent- KIADB to consider the representations dated 07.05.2024 and 27.05.2024 at Annexures-F and F1 respectively and pass necessary orders within a period of 30 days from the date of receipt of a copy of this order. (iii) It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner. The same would have to be ascertained and determined on the basis of the applicable Rules.
