Petitioner’s husband was a Group ‘C’ employee, who retired from the post of Mechanic from Uttarakhand Transport Corporation on 31.1.2022. After his retirement, an order was passed on 4.2.2022, providing for recovery of ₹3,95,123/- from the amount payable as gratuity to the petitioner. It is not in dispute that petitioner’s husband died on 20.1.2023. Petitioner is aggrieved by the order dated 4.2.2022, whereby recovery of a sum of ₹3,95,123/- was ordered to be made from the amount payable as gratuity to her husband. 3. Learned Counsel for the petitioner submits that the issue involved here is identical to the one decided by Division Bench of this Court in SPA No. 245 of 2022. He submits that this writ petition also deserves to be decided in terms of the judgment rendered in the said Special Appeal. 4. Mr. Shobhit Joshi, learned Counsel appearing for Uttarakhand Transport Corporation, concedes that the issue involved in the present writ petition is identical to the one decided by Division Bench of this Court in SPA No. 245 of 2022 and submits that writ petition can be decided in terms of judgment rendered in SPA No. 245 of 2022. 5. Accordingly, the writ petition is decided in terms of judgment dated 4.4.2024, rendered in SPA No. 245 of 2022.
