Accused in Crime No.37/2026 registered by Kumaraswamy Layout Police Station, Bengaluru City, for the offences punishable under Sections 109, 326, 351(2), 352 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.37/2026 was registered by Kumaraswamy Layout Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 13.02.2026 submitted by Smt. Anitha. In the said case, petitioner was arrested on 13.02.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court was rejected, and thereafter, he had approached this Court in Crl.P.No.5944/2026 which was dismissed as withdrawn for the reason that charge sheet was filed during the pendency of the said petition. Subsequently, the petitioner has filed this petition seeking regular bail. - 3 - HC-KAR NC: 2026:KHC:35521 CRL.P No. 8299 of 2026 4. Perusal of the material on record would go to show that first informant was wife of the petitioner herein. The marriage of the petitioner with the first informant was dissolved by a decree of consent divorce passed by the jurisdictional Civil Court at Pandavapura in M.C.No.51/2025 by judgment and decree dated 31.01.2026. A perusal of the order passed in M.C.No.51/2025 would to go show that the custody of two minor children born to the couple is given to the petitioner and he has been taking care of his children. In the alleged incident that had taken place on 13.02.2026 which is after the decree passed in M.C.No.51/2025, petitioner who had gone to the office premises of the first informant, had allegedly quarreled with her for the reason that she had relationship with her employer, and thereafter, petitioner allegedly had poured petrol on the first informant and also on the furniture in her office and lit fire. Undisputedly, the first informant or anybody else have not suffered any injury in the incident that had taken place on 13.02.2026. It is appears some of the furniture in the office was burnt in the alleged incident that had taken place on 13.02.2026. - 4 - HC-KAR NC: 2026:KHC:35521 CRL.P No. 8299 of 2026 5. Petitioner, who has no other criminal antecedents, is in custody for more than four months. Investigation of the case is completed and charge sheet has been filed. Considering the aforesaid aspects of the matter and more so since the petitioner is required to take care of the two minor children, I am of the opinion that his prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.37/2026 registered by Kumaraswamy Layout Police Station, Bengaluru City, for the offences punishable under Sections 109, 326, 351(2), 352 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR NC: 2026:KHC:35521 CRL.P No. 8299 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
