INDIRESH ORAL ORDER In this petition, the petitioner is seeking direction to the respondent No.3-Committee to comply with the order dated 18th November, 2016 (Annexure-A) passed by this Court in Writ Petition No.13786 of 2015 and order dated 05th April, 2022 (Annexure-B) passed by the respondent No.2 in Case No.L.N.D.C.R.No.169/2021-22. - 3 - HC-KAR NC: 2026:KHC:34998 WP NO.2826 OF 2026 2. Heard Sri. Somasekhara K.H., learned counsel appearing for the petitioner and Smt. Sharada H.V., learned Additional Government Advocate appearing for respondents 1 to 5. 3. Having heard the learned counsel appearing for the parties and on perusal of the finding recorded by this Court in the order dated 18th November, 2016 (Annexure-A) passed in Writ Petition No.13786 of 2015, it is forthcoming that the matter was remitted to the respondent No.2-Tahsildar to consider the application made by the petitioner, seeking regularisation of his unauthorised occupation in the land in question. On careful consideration of Endorsement dated 18th June, 2021 (Annexure-H), wherein the respondent No.2 has stated that the meeting of the respondent No.3-Committee was not taken place for two years due to COVID-19 Pandemic and Grama Panchayat Elections and therefore, the matter will be placed before the respondent No.3-Committee in the upcoming meeting. 4. Therefore, taking into consideration the fact that the endorsement dated 18th June, 2021 (Annexure-H) issued - 4 - HC-KAR NC: 2026:KHC:34998 WP NO.2826 OF 2026 by the respondent No.2 is of the year-2021 and the application made by the petitioner has not been placed before the respondent No.3-Committee in view of COVID-19 Pandemic and Gram Panchayat Elections, the respondent No.2 is directed to place the application of the petitioner before the respondent No.3 in terms of observation made by this Court in the order dated 18th November, 2016 (Annexure-A) passed in Writ Petition No.13786 of 2015, within a period of six months from the date of receipt of this order. The respondent No.3- Committee is at liberty to take decision in the matter in accordance with law. 5. It is made clear that, till the decision that may be taken by the respondent No.3-Committee on the application made by the petitioner for regularisation of his unauthorised occupation in land in question, the respondent-Authorities shall not take any coercive steps against the petitioner to dispossess from the land in question.
