Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents. 3. The contention of the petitioner is that the respondent authorities initiated proceedings under the provisions of the Andhra Pradesh Land Encroachment Act, 1905, and issued an eviction notice dated 18.10.2025 under Section 7 of the A.P. Land Encroachment Act, III of 1905. In support of his contention, the petitioner relied upon the judgment of the Hon’ble Supreme Court in Government of Andhra Pradesh v. Thummala Krishna Rao1. 1 AIR 1982 SC 1081 4 4. Upon considering the contentions raised by learned counsel for the petitioner, and in view of the fact that the petitioner has already submitted his reply dated 11.11.2025, which has not been considered by the respondent authorities, nor any order passed after affording an opportunity of hearing under Section 6 of the Act, this Court is not inclined to go into the merits of the matter at this stage. 5. Accordingly, the Writ Petition is disposed of at the stage of admission, directing the respondent authorities to consider the reply dated 11.11.2025 submitted by the petitioner, keeping in view the observations made by the Hon’ble Supreme Court in the judgment referred to above, and to pass appropriate orders after providing a reasonable opportunity of hearing to the petitioner under Section 6 of the Act. 6. Till such time, the respondent authorities are directed not to interfere with the peaceful possession of the petitioner and not to dispossess the petitioner from the subject property. 7. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ JUSTICE D.
