1. Learned counsel for the petitioners submits that default pointed out by the Registry has already been removed.
2. By way of this petition, the petitioners seek the following reliefs : (i) That, this Hon'ble Court may kindly be pleased to issue an appropriate writ by directing the respondent authorities to immediate provide caste certificate of the petitioners on the basis of caste certificate of the father of the petitioner Chetan Kumar Lachoria due to needed for next academic session, in the interest of justice. (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.
3. Learned counsel for the petitioners submits that the application of the petitioners for issuance of a Social Status Certificate(s) remains pending. He submits that the petitioners were verbally informed by the concerned authority that the Certificate cannot be issued due to the non-submission of documents prior to 1950. The father of the petitioners namely Chetan Kumar was issued a Social Status Certificate (Annexure P/2) way back on 24.10.1994. He submits that the authorities did not consider this material aspect, whereas they are legally bound to pass an appropriate

order granting a similar certificate to the petitioners, who belong to ‘Koli’ Caste, which is a recognized Scheduled Caste under the Presidential Order, 1950.

Per contra, learned counsel for the State submits that it appears that no order, either approving or rejecting the application of the petitioners for issuing a Social Status Certificate, has been passed. He submits that if the Certificate has not yet been issued, a direction may be given to the authorities to pass an appropriate
order in accordance with law, after considering the documents submitted by the petitioners.
5. Heard learned counsel for the parties and also perused the documents annexed with the petition carefully.
6. Evidently, the father of the petitioners namely Chetan Kumar was granted a Social Status Certificate on 24.10.1994. The claim of the petitioners, being the sons of a Certificate holder, must be considered from this perspective. So far as the requirement of documents prior to 1950 is concerned, the petitioners are at liberty to file an appropriate application along with an ‘Inability Certificate’ for that period.

Considering the facts and circumstances of this case, this Court deems it appropriate to direct the concerned respondent authorities to consider the case of the petitioners, particularly considering the Social Status Certificate issued to their father, and pass an appropriate order in accordance with law. Further, since the application has been pending since 22.11.2024, the authorities concerned are directed to pass appropriate orders on the
4 application of the petitioners for issuance of Social Status Certificate(s) under the ‘Koli’ Caste (Scheduled Caste). The petitioners shall submit all relevant documents along with the requisite form(s) {application} before the concerned authority within two weeks from the date of receipt of a copy of this order. In turn, the competent authority shall consider and decide the said application(s) of the petitioners within a period of 60 days from the date of receipt of the said application. Ordered accordingly.
8. With the aforesaid observations/directions, the Petition is finally
