Heard both sides. 2. This transfer petition is filed by the petitioner – wife and she has sought for transfer of M.C.No.88/2025 filed by the respondent for divorce before the I Additional Senior Civil Judge and JMFC, Chamarajanagara to I Additional Principal Judge, Family Court, Bengaluru. 3. It is stated that she is residing in Bangalore with her parents and brother. She also filed M.C.No.166/2026 under Section 12 of the DVC Act. It is stated that the respondent is well settled, is doing cable network business and earning

Rs.4,00,000/- per month. It is further stated that it is inconvenient for her to travel to Bangalore. 4. In an objections filed by the respondent counsel, it is stated that mere filing of an application under DVC Act is not a reason to transfer. That marriage was performed in the year 2024. Presently he is not working and earning. He has very limited financial means and his parents are depending on him and he has to take care of their day to day needs in medical care. His father is handicapped and frequent travel to Bengaluru will cause inconvenience to him and will have adverse effect on the well being of his parents. 5. Admittedly, both the parties have filed two applications, one for divorce and one for restitution of conjugal rights. Both the cases are be tried together by one Court to avoid conflicting of judgments. The distance between both the places is 170 Kms. Initially husband filed O.P. for divorce and later she filed for restitution of

conjugal rights. However she is residing with her parents at Bangalore and depending on them. Therefore this Court finds it reasonable to transfer M.C. No. 88/2025 from I Additional Senior Civil Judge and JMFC, Chamarajanagara to I Additional Principal Judge, Family Court, Bengaluru to try along with M.C. No. 1601/2026 filed for restitution of conjugal rights. 6. The Family Court is specifically directed to club the matters and dispose of them to avoid conflicting decisions. Family Court is also directed not to insist upon the presence of the respondent unless there is any requirement. 7.
Respondent is at liberty to file an affidavit and he can be cross-examined either through Commissioner or through video conferencing. 8. Accordingly, Civil Petition is allowed. - 5 -
