Learned counsel for the respondent would submit that the present writ petition is arising out of the order dated 21.04.2023 passed by learned Commercial Court (District Level), Nava Raipur (C.G.) in Execution SUMIT KUMAR Digitally signed by SUMIT KUMAR 2 Case No. 09/2022 whereby the objection raised by the petitioner regarding payment of stamp duty over the arbitral award has been rejected. She would further submit that during the pendency of the present writ petition, the requisite stamp duty on the arbitral award has been paid before the learned Commercial Court (District Level), Nava Raipur. She would also submit that earlier the respondent paid Rs. 32,900/- as stamp duty on the arbitral award and subsequently on 04.05.2026, the respondent has paid the deficit stamp duty of Rs. 2,95,944/- on the arbitral award and thus the total stamp duty of Rs. 3,28,844/- have been paid by them and now, nothing survives for adjudication in the present writ petition, as the controversy is confined only to the payment of the requisite stamp duty on the arbitral award. 2. Learned counsel appearing for the petitioner would submit that the present writ petition may be disposed of directing the learned Executing Court to verify about the requisite stamp duty and the stamp duty paid by the respondent and if they satisfied, proceed in accordance with law in the execution proceeding. 3. I have heard learned counsel for the parties and considered their submissions. 4. Considering the submissions made by learned counsel for the parties and also on the basis of the statement made by learned counsel for the respondent regarding payment of the requisite stamp duty on the arbitral award, the present writ petition is disposed of directing the learned Commercial Court (District Level), Nava Raipur (C.G.) to verify about the payment of requisite stamp duty on the subject arbitral award and upon being satisfied, proceed with the execution proceedings in 3 accordance with law. 5.
