Saheb Bag Vs. The State of West Bengal & ors.
Adv. Sk. Toslim Ali, …for the petitioners. Adv. Goutam Mishra, Adv. Sailen Naskar, …for the State.
Report submitted by the State is taken on record. The petitioner has assailed the notices issued by the Pradhan, Sankarhati II Gram Panchayat requesting him to return the amount of Rs.60,000/- deposited in his account. Learned counsel for the petitioner submits that the said amount has been deposited in his account since he applied for sanction under “Banglar Bari Prokolpo” and the said amount has been sanctioned in his favour for raising construction under the scheme. It appears from the report submitted by the State that the amount of Rs.60,000/- was allotted in favour of one Saheb Pandit and was wrongly deposited in the name of the petitioner who is Saheb Bag. The mistake was subsequently detected and notices issued upon the petitioner to return the said amount. In view of the fact that the amount of Rs.60,000/- was allotted in favour of one Saheb Pandit for raising construction under the scheme and has been wrongly deposited in the bank account of the petitioner, the petitioner is directed to return the said amount to the Panchayat within seven days from date. Though it appears
2 that the petitioner applied for raising construction under the same scheme, there is nothing on record to suggest that the application was allowed and fund sanctioned in his favour. The writ petition is accordingly disposed of directing the petitioner to deposit the amount of Rs.60,000/- before the concerned Panchayat within seven days from date. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
