ORAL ORDER
1. Accused no.2 in Crime No.58/2026 registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District, for the offences punishable under Sections 352, 351(1), 332(b), 76 of BNS, 2023, and Sections 12, 8 of POCSO Act, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the petitioner and the learned HCGP for respondent no.1-State. Respondent no.2 has remained unrepresented before this Court. 3. FIR in Crime No.58/2026 was registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District, for the aforesaid offences against Darshan and the petitioner herein based on the first information dated 12.02.2026 received from respondent no.2, who is the mother of the alleged victim girl aged about 17 years. Apprehending arrest in the said case, petitioner who is the father of accused no.1 had filed Crl. Misc. No.298/2026 before the jurisdictional Sessions

Court, which was rejected on 09.06.2026. Therefore, he is before this Court. 4.
In the first information dated 12.02.2026, mother of the victim girl aged about 17 years, has stated that accused no.1, who is the son of the petitioner was pestering the minor victim to love. After coming to know about the same, her parents had discontinued the education of the victim girl. Even after that, accused no.1 allegedly was following the victim girl and on 09.02.2026 when there was nobody inside the house, accused no.1 who entered the house of the first informant, allegedly caught hold of the victim girl and tried to rape her. Thereafter, when accused no.1 heard somebody knocking the door of the house, he allegedly ran away from the house. It is in this background, on 12.02.2026, the first informant and her relatives had gone near the house of accused no.1 and it is alleged that accused no.1 and the petitioner who is the father of accused no.1 abused the first informant and others who had gone near the house of accused no.1 and also criminally intimidated them. It is further alleged that the accused persons

threatened to circulate the private photos of the victim girl which was with accused no.1. 5. The material on record would go to show that accused no.1 was arrested in the present case during the course of investigation and he was released on regular bail. Investigation of the case is completed and charge sheet has been filed. Considering the nature of allegations made against the petitioner herein who is the father of accused no.1, I am of the opinion that his prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order:
6. The petition is allowed.
The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.58/2026 registered by Chikkamagaluru Rural Police Station, Chikkamagaluru District, for the offences punishable under Sections 352, 351(1), 332(b), 76 of BNS, 2023, and Sections 12, 8 of POCSO Act, subject to the following conditions:
1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two

sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
