Coram:
Hon’ble Mr. Justice Rajnesh Oswal, Judge
ORDER 07.09.2026
1. The petitioner has filed this petition for commanding the respondent No. 1 and 2 to take immediate lawful preventive measures for preventing any breach of peace, confrontation, cognizable offence or law and order situation in connection with the plying of passenger vehicles on the Khaipora-Tangmarg route. The petitioner has also sought issuance of direction to the respondent No. 2 to ensure that the petitioner’s passenger vehicles and drivers are not unlawfully stopped, obstructed, intimidated, diverted or interfered with, in light of order dated 14.08.2026 passed by the Assistant Reginal Transport Officer, Baramulla.
2. The mode and manner in which the present petition has been filed is very unique as the petitioner has placed on record resolution authorizing him to file the present petition but at the same time in para (1) of the petition he has stated that he has filed the present petition in his individual capacity. The petitioner has not able to give particulars of the vehicles/drivers in the present petition. The petition being vague, as such, cannot be taken cognizance of and is accordingly dismissed with liberty to the petitioners to file fresh with better particulars.
