1. Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant, who is in custody since 29.12.2025, has approached this Court for grant of regular bail in connection with Dhanwar P.S. Case No.249 of 2024, registered for the offence under Sections 126/ 191(1)/ 191(2)/ 115(2)/ 117(2)/ 109/ 103(1)/ 61(2) read with Section 3(5) of the BNS, 2023. 3. It has been submitted by the learned counsel for the applicant that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his/ her part. Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted that there was free fight between the parties over the land dispute. It has further been submitted that similarly situated co-accused persons have already been enlarged on bail by the Co-ordinate Bench of this Court vide orders dated 17.02.2025 and 22.08.2025, passed in B.A Nos.1284 of 2025 & 5816 of 2025 respectively. On the above basis, prayer for bail has been made. 4. On the other hand, learned counsel for the State has opposed the prayer for bail. 5. Considering the above facts, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- - 1 - B.A. No.1904 of 2026
2026:JHHC:9086 (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Dhanwar P.S. Case No.249 of 2024, on the condition that this applicant will submit self attested photocopy of his Aadhaar Card and his mobile number before the learned trial court which he will always keep active and will not change it during pendency of this case without prior permission of the court.
