… for the State-respondent(s)
The petitioner is in custody for one year six months and the evidence of the victim is over, as such, learned advocate prays that the petitioner may be released on bail. It has also been submitted that three witnesses have already been examined and the next date has been fixed for the evidence of P.W.4. Learned advocate for the State produces the case diary. I have taken into account the evidence of the victim as well as the medicolegal examination report. Considering the overall sequences of the evidence supported by the medicolegal examination report, prima facie, I am of the view that the victim’s version has been fortified subject to the cross-examination.
2 Having considered the materials appearing and the heinousness of the offence, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1061 of 2026 is dismissed. Report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
