JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in C.C.No.27453/2025 registered for an offence punishable under Sections 34, 498A, 504, 120B and 313 of the Indian Penal Code, 1860. - 4 - HC-KAR NC: 2026:KHC:33256 CRL.P No. 15833 of 2025 C/W CRL.P No. 5822 of 2025 2. Heard Sri. Rajath, learned counsel appearing for the petitioners, Ms. Deepti Alva, learned High Court Government Pleader appearing for respondent No.1 and Sri. Vinay T.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and the memorandum of settlement reads as follows: “MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. I. The Petitioner has filed this petition against the Respondent under section 13 (1) (ia) & (ib) of the Hindu Marriage Act, 1954 for Dissolution of the Marriage with the Respondent with counter claim VIII Rule VI(a) R/w 23(a) under section 13 (1) (i- a) (i-b) of Hindu Marriage Act, 1954. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation the Respondent appeared through video conference and the Petitioner and their respective counsel were present physically, identified each other and have resolved their dispute and have agreed to the following terms and conditions: - 5 - HC-KAR NC: 2026:KHC:33256 CRL.P No. 15833 of 2025 C/W CRL.P No. 5822 of 2025 1. The parties state that their marriage was solemnized on 29.05.2019 at Star Convention Center, Bengaluru as per Hindu rites and customs. Subsequently their marriage was registered on 21.06.2019 before the Registrar of Marriage, Jayanagar, Bengaluru vide marriage certificate No.JAY- HM269-2019-20 stored in C.D.No.JAYM52. 2. The parties state and admit that due to irreconcilable differences and incompatibility of temperaments, they are living separately from 22.01.2022. The efforts made by the elders, friends and well wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of a reunion between them. The petitioner and the respondent know that their marriage is irretrievably broken down and there are no chances of reunion to lead a happy married life. Hence, the petitioner and the respondent have decided to get the marriage dissolved by a decree of divorce. 3. The Petitioner and the Respondent state that they have no children born to them from their wedlock. 4. Both the Parties state that the Petitioner has paid a sum of Rs.75,000/- (Rupees Seventy Five Thousand Only) Only) to the house owner who is the father of the Petitioner. Hence the Respondent has returned a sum of Rs.63,000/- (Rupees Sixty Three Thousand Only) to the Petitioner by way of Googlepay, after deducting the tuition fees of Rs.12,000/-(Rupees Twelve Thousand Only) which was paid by Respondent. The Petitioner has acknowledged the receipt of Rs.63,000/- (Rupees Sixty Three Thousand Only). 5. Both the parties state that they have no claims of maintenance/permanent alimony either past, present or in future as both of - 6 - HC-KAR NC: 2026:KHC:33256 CRL.P No. 15833 of 2025 C/W CRL.P No. 5822 of 2025 them are capable of maintaining themselves independently. 6. The parties here in state that they have already exchanged their valuables such as gold, silver, artefacts, books, clothes, watches and other valuables given or taken during the marriage or otherwise, hence they have no claims against each other in this regard. 7 The parties herein state that they have no claims over the movables/immovable's belonging to each other at present or to be acquired in future in view of this agreement. 8. The Petitioner and the Respondent have no other claims, of any nature whatsoever, against each other, whether past, present or in future. 9. In view of this settlement the parties have agreed to withdraw/close/quash the following cases in accordance with law: a) That the Petitioner has lodged a complaint against the Respondent and his parents in South Women Police Station, Bengaluru City for the offence punishable under section 34,498-A, 504, 120B, 313 of IPC the same was registered FIR No.155/2027. The same is numbered as C.C.No.27453/2025 pending on the file of 37th ACJM, Bengaluru. That the Respondent and others have preferred a Crl.P.No.15833/2025 connected with Crl.P.No.5822/2025 before the Hon'ble High Court of Karnataka, Bengaluru Bench for the relief of quashing the C.C.No.27453/2025. The Petitioner has agreed to co-operate a for early disposal/quashing of C.C.No.27453/2025. b) NCR No.84/2026 filed by the Respondent against the Petitioner's mother and her - 7 - HC-KAR NC: 2026:KHC:33256 CRL.P No. 15833 of 2025 C/W CRL.P No. 5822 of 2025 relatives before the Lakshmipuram Police Station, Mysore. c) C.R.No.42/2026 filed by Petitioner against the Respondent before the Wilson Garden Police Station, Bengaluru. 10. Both the Parties admit and agree that there is no collusion or force, fraud and undue influence in agreeing/ settling the aforesaid terms and conditions and entering into this Agreement in the aforesaid manner. 11. Both the parties state that without pressing on the allegations levelled against each other either orally or expressly arrived at this agreement. 12. Both the parties undertake to not to interfere in each other's lives in future in any manner. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 29.05.2019 at Star Convention Center, Bengaluru and cancel their marriage certificate registered on 21.06.2019 before the Registrar of Marriage, Jayanagar, Bengaluru vide marriage certificate No.JAY-HM269-2019-20 stored in C.D.No.JAYM52 by granting a decree of divorce in terms of this agreement. IV. The petitioners have to appear before the Hon'ble Court as directed and when the date of appointment given by Hon'ble Court for passing appropriate orders in terms of the agreement." 4.
