Affidavit of service filed on behalf of petitioner is taken on record. 2. Matter is heard in presence of learned advocates representing petitioner, State respondents and respondent nos.7 and 8. 3. On hearing learned advocates representing parties, it appears that prayer is made in this writ petition for registering FIR based on the complaint lodged and to investigate alleged offence. 4. State respondents are represented by Mr. Das, learned Additional Government Pleader, who has filed a communication dated 8th July, 2026 of Inspector- in-Charge of Budge Budge Police Station and same is 2 taken on record. Copy of the said communication is made over to learned advocate representing petitioner. 5. There is an alternative remedy available to petitioner to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023. In this regard, reliance is placed on the judgment of the Hon’ble Supreme Court, reported in (2007) 6 SCC 171 (Aleque Padamsee & Ors. –v. Union of India & Ors.). 6. Due to availability of alternative remedy, writ petition is not entertained and same stands dismissed. 7. However, this order shall not preclude petitioner to approach the jurisdictional Magistrate, in pursuit of remedy. 8.
