JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.177/2026 registered by the Banaswadi Police Station, Bengaluru, for the offences punishable under Sections 118(1), 352, 118(2) and 109(1) read with Section 3(5) of BNS, 2023, is before this Court in this Criminal Petition filed under Section 483 of BNSS seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.177/2026 was registered by the Banaswadi Police Station, Bengaluru, initially for the offences punishable under Sections 118(1), 352 r/w 3(5) of BNS, 2023 against four unknown persons and others based on the first information dated 09.03.2026 received from Smt. Preethi, who is the wife of injured victim Sri. S. Murugan. The petitioner was arrested on 21.04.2026 and remanded to judicial custody. The - 3 - HC-KAR NC: 2026:KHC:34980 CRL.P No. 7451 of 2026 petitioner's bail application in Crl.Mis.No.25397/2026 was rejected by the jurisdictional Sessions Court on 12.05.2026. Therefore, petitioner/accused No.2 is before this Court. 4. In the first information, which is submitted by the wife of the injured victim, she has stated that when her husband S. Murugan, who is the victim in the present case, had gone to the saloon, four unknown persons wearing helmets entered the saloon and had assaulted her husband causing grievous injuries and thereafter escaped from the spot. She has stated that her husband who was in the real-estate business had some differences with accused named in the FIR and therefore, she suspected the hand of the said accused in the present case. 5. Perusal of the record would go to show that the name of the petitioner is not found in the FIR in Crime No.177/2026. During the course of investigation, the petitioner and some of the other accused were arrested. The police record would reveal that accused by name, Parthiban, Daniel A, Arun and Sharath Kumar, had entered the saloon on the alleged date of incident and assaulted Murugan. The petitioner herein is one of the assailants who had assaulted Murugan on the alleged date - 4 - HC-KAR NC: 2026:KHC:34980 CRL.P No. 7451 of 2026 of incident. Daniel A and Sharath Kumar S, who are the other two assailants had approached this Court Crl.P.No.7409/2026 seeking regular bail and their petition has been allowed by the Co-ordinate bench of this Court on 29.05.2026. Subsequently, investigation has been completed and charge-sheet has been filed. 6. Under these circumstances, the following:- ORDER (i) The petition is allowed. (ii) The petitioner/accused No.2 is ordered to be enlarged on bail in Crime No.177/2026 registered by the Banaswadi Police Station, Bengaluru, for the offences punishable under Sections 118(1), 352, 118(2) and 109(1) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court - 5 - HC-KAR NC: 2026:KHC:34980 CRL.P No. 7451 of 2026 unless the Trial Court exempts there appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
