The petitioner who is the Pradhan of Jalalpur Gram Panchayat submitted an application under Section 11(1)(d) of the West Bengal Panchayat Act, 1973 against the private respondents who are members of the Panchayat seeking their removal on the ground of their absence in three consecutive meetings of the Panchayat despite service of notice upon them. The petitioner seeks a direction upon the Prescribed Authority to deal with the application at the earliest. Learned counsel for the private respondents submits that the notices of the meetings were not served upon the private respondents for which they were unable to attend the same. The 11th respondent attended one of the three meetings referred to by the petitioner. It is a fact that no time frame has been stipulated under the Act for disposal of the applications under Section 11 of the Act. But that does not mean that the Prescribed Authority shall sit tight over the application and not dispose of the same within a reasonable time. Since the application has been filed on June 22, 2026 and is still pending, the Prescribed Authority and Sub-Divisional Officer, Malda, being the 4th respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
