In the interim the respondents JSSC may be directed to stay the appointment process till the disposal of the instant writ petition or reserve 03 seats for the writ petitioners subject to outcome of the writ petition;
2. At the outset, learned counsel for the petitioners submits that the issue involved in this writ application is squarely covered by the order passed by this Court in W.P.(S) No. 3337 of 2025, wherein this Court has granted relief to the petitioners of the said case with regard to admissibility of two years/three years B.Ed. Degree. 3. Learned counsel for the respondents though does not dispute that the issue involved in this writ application is almost same and similar to that of W.P(S) No. 3337 of 2025; however, he submits that an appeal has been preferred before the Division Bench of this Court; therefore, let this case be listed after disposal of L.P.A. No. 510 of 2025. 4. Learned counsel for the petitioners submits that though the said L.P.A has been admitted, but the impugned order has not been stayed, rather contempt proceeding has been kept in abeyance. For brevity the order dated 10.08.2026 passed in L.P.A. No. 510 of 2025 is extracted hereinbelow;
"Heard learned counsel for the parties. 2. We admit this appeal. 3. By way of interim relief we direct that 70 posts must not be filled in because should the appeal be dismissed, there should be posts available for the appointment of respondent Nos. 1 to 70, who were the writ petitioners before the learned Single Judge. 4.

Further, the contempt proceedings, if any, shall not proceed until the disposal of this appeal. 5. I.A. No. 4473 of 2026 for expeditious hearing and I.A. No. 11222 of 2025 for interim relief are disposed of. 6. Ι.Α. No. 8695 of 2026 and I.A. No. 12551 of 2025 seeking intervention in this appeal are concerned, we dispose them of with

No. 3010 of 2026 seeking condonation of delay of 184 days in instituting this appeal is allowed because the reasons set out in the I.A. constitutes sufficient cause. 10. Accordingly, we condone the delay and dispose of I.A. No. 3010 of 2026. 11. Similarly, I.A. No. 3011 of 2026 for interim relief is also
disposed of considering the order made in L.P.A. No. 510 of 2025.

13. Hearing of the two LPAs is expedited. Liberty to apply for a peremptory date in January, 2027."
5. As admitted by Ld. Counsel for the State that this case is squarely covered by the judgement rendered by this Court in W.P.(S) No. 3337 of 2025 and L.P.A. against the said order is pending; however, so far as the contention of counsel for the Service Commission that this case may be posted after disposal of L.P.A. No. 510 of 2025; this Court is not accepting the said contention in view of the fact that the said order has not been stayed and only the proceeding for contempt has been kept in abeyance; therefore, since the issue are same and similar; similar benefit shall be granted to these petitioners;
6. As a result, the instant writ petition stands allowed. Pending I.A(s), if any, also stands closed.
