Affidavit of service filed on behalf of petitioner is taken on record. 2. Mr. Chakraborty, learned advocate representing petitioner submits that though a Title Suit, being No.5 of 2021, instituted by respondent no.5 is pending but petitioner alleged threatening at the instance of the private respondents which prompted petitioner to lodge complaint with the concerned police authorities. Petitioner prays for necessary direction upon the concerned police authorities for preserving his right over the property in question and to provide protection in the event petitioner is subjected to threat. 3. Mr. Mazumder, learned Additional Advocate General representing State respondents has filed a communication dated 3rd July, 2026 of Officer-in- 2 Charge of Jangipara Police Station and same is taken on record. Copy of the said communication dated 3rd July, 2026 is made over to learned advocate representing petitioner. 4. It is disclosed in the said communication that on receipt of complaint, a non-cognizable report dated 26th June, 2026 under Sections 126/135(3) of BNSS, 2023 was submitted. However, it is also contended on behalf of State respondents that the issue involved in the writ petition is civil in nature. 5. In view of pendency of proceeding before the civil Court in connection with the aforesaid suit, petitioner needs to approach the civil Court in pursuit of remedy. Police authorities are not the appropriate authorities to decide inter se right of the parties in connection with the said suit. 6. However, concerned police authorities are directed to maintain peace and tranquility at the locale and to see no untoward incident takes place. 7. Writ petition stands disposed of. 8.
