2. By way of this petition, the petitioners seek the following reliefs : i. The Hon'ble Court may kindly be pleased to call for the entire records, pertaining to order dated 31/01/2022 passed by the State Transport Appellate Tribunal, Raipur, Chhattisgarh, in Appeal Case No. A 31/2021. ii. The Hon'ble Court may kindly be pleased to issue a writ of certiorari for quashing/setting aside the order impugned dated 31/01/2022 passed by the State Transport Appellate Tribunal, Raipur, Chhattisgarh in Appeal Case No. A 31/2021. iii. Cost of the petition be allowed. iv. Any other relief, which this Hon'ble Court deems fit and proper under the facts and circumstances of the case. 3. Learned counsel for the petitioners/State submits that the STAT passed an order of remand to the concerned RTA, which is not in accordance with law. As such, this petition has been filed. 4. Evidently, by the impugned order dated 31.1.2022, the STAT remitted the matter to the RTA with a direction to issue a stage carriage permit to the appellant/respondent No.1 within 30 days in accordance with the proposed regional route and time cycle and to submit a compliance report before the Tribunal. Further, the STAT directed the RTA to refrain from repeatedly publishing notices on the same application or conducting fresh hearings for the concerned respondents and objectors. 3
5. Considering the facts and circumstances of this case and also considering the arguments advanced by learned counsel for the parties, this Court finds that although the petitioner assails the impugned order on the ground that the remand is not in accordance with law, the order of remand was passed way back on 31.1.2022 and no steps were taken thereafter by the petitioners. Furthermore, the petition lacks merit as the STAT has passed the order in accordance with law
6. Consequently, in the interest of justice, the impugned order passed by the STAT is hereby affirmed. The Regional Transport Authority is directed to consider the directions issued by the STAT and pass appropriate orders. 7. Respondents 1 & 2 are directed to appear before the RTA, Raipur on 19.8.2026. The concerned RTA shall pass appropriate orders in accordance with the impugned order dated 31.1.2022 passed by the STAT, after giving the parties a due opportunity of hearing. 8.
With the aforesaid observations/directions, the Petition is finally
disposed of. Sd/-
