Rakib (Rejected) CRM (NDPS) 923 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Burdwan Sadar Police Station case no. 835 of 2024 dated 29.08.2024 under Sections 20(b)(ii)(c)/25/29(1) of the NDPS Act. And In the matter of : Dhirendra Shaw & Anr. ……Petitioners. Mr. Debarshi Brahma Mr. Subarna Bank Mr. Sayantan Maity .....for the Petitioners. Ms. Arushi Rathore ……for the State. Learned advocate appearing for the petitioners submit that the prosecution is unable to produce the witnesses for which the trial of the case is being delayed. Petitioner is in custody for more than one year 10 months and only three witnesses out of the cited 9 witnesses cited in the charge-sheet has been examined till date. Learned advocate appearing for the State opposes the prayer for bail in view of 60 kgs ganja having been recovered. Having considered the quantum of recovery, at this stage, I am not inclined to grant bail to the petitioner. However, the petitioner will renew his prayer for bail after the evidence of the independent seizure list witnesses are over. Learned trial Court is directed to pre-pone the evidence of the independent seizure list witnesses and complete the same within 2 a period of three months from the date of communication of this Court. With the aforesaid observations, at this stage CRM (NDPS) 923 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
