Case No. 1993 of 2023). And In Re : Milon Mukherjee ... Petitioner. Mr. Santanu Talukdar, Mr. Subir Debnath, Mr. Manojit Debnath ... For the Petitioner. Mr. Rajendra Banerjee, APP, Mr. Amal Kumar Datta ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 3 years 3 months and till date, out of nine witnesses cited by the prosecution, only three witnesses have been examined. Learned advocate appearing for the State opposes the prayer for bail and submits that petitioner has killed his mother. Learned advocate for the petitioner, on the other hand, submits that there is no supporting evidence and petitioner has been victimised in respect of the murder of his mother. Be that as it may, having considered the period for which the petitioner is in custody and there is no possibility of the trial concluding in near future and also there is no criminal antecedent of the present petitioner, without 2 entering into the merits of the case, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Milon Mukherjee shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Trial Court. Learned APP appearing for the State prays for expediting the trial. As such, learned Trial Court would ensure that trial is expedited. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. Mr. Rajendra Banerjee, learned APP along with Mr. Amal Kumar Datta, learned advocate was directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities. The application for bail, being CRM (M) 2866 of 2025, is, thus, disposed of.
