2. As per the prosecution’s case, in brief is that on 27.05.2026, acting upon secret information, the police intercepted certain persons who were allegedly transporting six cattle through forest routes in a cruel manner. During the said operation, one accused person, namely Suraj Bhagat, was apprehended and the cattle were seized. During the course of investigation, the present applicant came to be implicated solely on the basis of the statements and materials collected by the investigating agency. Hence, the present application seeking anticipatory bail.
3.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the allegations levelled against the applicant are false, baseless and fabricated, and that he has neither committed nor participated in any act constituting the offences alleged against him. It is further submitted that no cattle were seized from the possession of the applicant and that he was not present at the spot at the relevant time. The cattle were allegedly being transported by co-accused Suraj Bhagat, from whose possession the cattle were seized. The prosecution has not collected any cogent or prima facie material connecting the applicant with the alleged offence, and his implication is based merely on his name being mentioned in the FIR, which by itself is insufficient to establish his involvement in the crime. He further submits that the applicant is a farmer by occupation and has no role in the alleged incident. It is also pointed out that co-accused Shiv Kumar Yadav has already been granted bail by the learned Trial Court vide order dated 01.06.2026, and
3 another co-accused, Hemant Yadav, has been granted anticipatory bail by this Hon’ble Court in M.Cr.C. (A) No. 999/2026 vide order dated 02.07.2026, and therefore, on the ground of parity also, the present applicant is entitled to the benefit of anticipatory bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant is not entitled for grant of anticipatory bail in this case. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature of allegations levelled against the applicant, the fact that no cattle were seized from the possession of the applicant, the allegation that the cattle were recovered from the possession of co-accused Suraj Bhagat, the absence of any specific overt act attributed to the applicant, and further this Court has also taken into consideration the fact that similarly placed co-accused namely, Shiv Kumar Yadav, has already been granted bail by the learned Trial Court vide order dated 01.06.2026, and another co-accused, Hemant Yadav, has been granted anticipatory bail by this Court in M.Cr.C. (A) No. 999/2026 vide order dated 02.07.2026.
Therefore, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is also entitled to be granted anticipatory bail in this case on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Vidya Yadav on executing a
4 personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. Sd/-
