For Respondents No. 2 to 4 : Mr. Abhishek Sinha, Senior Advocate assisted by Mr. Ghanshyam Patel, Advocate 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 20.7.2026 1) By way of this petition, the petitioner has sought following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to issue a appropriate writ/order/direction to the respondent authorities to considered the claim of the petitioner for obtaining employment, to the petitioner, as per the Notification and under the ( आदर्श पुर्नवा स र्नति 2007 एवा मड़वा न्दूभा ठा पु तिवाद्यु पुरियोजर्न हे  र्श सर्न द्वा  अर्नमदिद पुर्नक्षण पुर्नवा स योजर्न ). 10.2 Any other relief which the Hon'ble Court deems fit in the circumstances of the case may be given. 2) Learned counsel for the petitioner submits that lands belonging to petitioner bearing Khasra No. 577/4 ad-measuring 0.25 acre and Khasra No. 579/1 ad-measuring 0.005 acre situated at Village Kanhaiband, P.H. No. 50, Tehsil – Janjgir, District – Janjgir Champa were acquired by the respondents No. 2 to 4 for construction of power plant. He further submits that though petitioner has been granted compensation but according to the applicable rehabilitation policy, he has not been offered appointment in lieu of land acquisition. He prays that petitioner may be permitted to make a representation in this regard before the respondents No. 2 to 4, who in turn may be directed to the decide his claim at the earliest. 3) On the other hand, learned Senior counsel appearing for the respondents No. 2 to 4 submits that name of petitioner was initially considered for appointment to the post of Line Attendant 3 (Contract) but a report was submitted by the Land Acquisition Officer to the effect that petitioner had purchased the subject land much later and he was not the owner of acquired land three years prior to the publication of notification under Section 4(1) of the Land Acquisition Act, 1894, therefore his claim for appointment was rejected. 4) Heard. 5) Taking into consideration the limited prayer made by Mr. Kalamkar, this petition is hereby being disposed reserving liberty in favor of petitioner to make a detailed representation ventilating his grievance before the General Manager, Chhattisgarh State Power Generation Company Limited (A Govt. of CG Undertaking) Vidyut Bhawan, Dagnia, Raipur (C.G.) within period of 30 days. It is expected that the authority concerned shall decide the claim of petitioner by way of a speaking order, preferably within period of 120 days from the date of receipt of copy of such representation. 6) With the aforesaid direction, this writ petition stands disposed. However, it is made clear that this Court has not expressed any opinion on the merits of the case.
