And In the matter of : Chhotelal Yadav. ……Petitioner. Mr. Md. Wasim Akram .....for the Petitioner. Mr. Shataroop Purkayastha ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than one year and there has been alleged recovery of 502 grams of heroin. Learned advocate appearing for the State submits that since some of the accused persons are absconding and the execution is pending, the trial of the case cannot be progressed in spite of the charge-sheet having been submitted within the statutory period. The chemical examiner’s report do not support the case of the petitioner. Having considered the same, I am not inclined to release the petitioner on bail. However, the learned Special Court is directed to split up the trial of the case after exhausting the whole of the process. At this stage, the prayer for bail of the petitioner in CRM (NDPS) 918 of 2026 is rejected. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
