Ms. Sneha Chatterjee, Adv. …For the State Mr. Probal Mukherjee, Sr. Adv. Mr. Kaushik Chatterjee, Adv. Mr. Tirthankar Dey, Adv. …For the Respondent No.7 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. It is submitted on behalf of the petitioner that petitioner is being prevented from entering into a temple situated on the land in question thereby denying petitioner’s right. 3. Prayer is made in this writ petition for direction upon the concerned police authority to take necessary steps which would prevent respondent no.7 from obstructing the petitioner to enjoy possession of the land in question. 4. Mr. Probal Mukherjee, learned Senior Advocate representing the respondent no.7 has opposed this writ petition on the count that respondent no.7 has right over the land in question and in this regard reliance is placed on a deed relating to the said land. 5. State respondents are represented by Mr. Suryaneel Das, learned Additional Government Pleader. [2] 6. Having considered the respective submissions made on behalf of the parties, it appears that petitioner and respondent no.7 are claiming right over the land in question requiring the parties to approach Civil Court. 7. Police authority is not the appropriate authority to decide inter se right of the parties over the land in question. 8. Writ petition stands dismissed. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
