10.07.2026 Serial no. 23 [G.S.D] CRM (M) 2848 of 2025 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with GR Case No. 1532 of 2025 SSL No. 168 of 2025 arising out of Suti Police Station Case No. 404 of 2025 dated 15.04.2025 u/s 189(3)/324(5)/326(g)/303(2)/109/121(1)/121(2)/132/221/190/191(2) of the BNS, Sections 3/4 of the Prevention of Damage to Public Property Act, 1984 and Section 8B of National Highways Act 1956, Sections 9/15A/15B of the West Bengal Maintenance of Public Order Act, 1972. -And- In the matter of : Jullu Sk @ Ajfarul Sk @ Julu Sk & Ors. … Petitioner(s) Mr. Moyukh Mukherjee Mr. Anisur Rahaman Ms. Sarmistha Basak … for the Petitioner(s) Mr. Rajendra Banerjee, ld. APP Mr. Amartya Mohan Bhattacharyya … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are unnecessarily detained for a period of one year two months; they are innocent of the charges and there is no possibility of the trial being concluded in the near future, as such, learned advocate prays that the petitioner may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail and submits that majority of the witnesses have already been examined out of the 47 witnesses as relied upon in the charge-sheet. 2 Learned advocate for the State proposes to complete the trial within a reasonable period of time. The petitioners are in custody for one year two months. Having considered the pace with which the trial is progressing as also taking into account the manner in which the State property was vandalized, I am of the opinion that some opportunity be granted to the State to take the trial to its logical conclusion. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (M) 2848 of 2025 is dismissed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.) 3
