13.07.2026 Court No.35. D/L.11. Rakib (Rejected) CRM (NDPS) 1405 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Domkal Police Station case no. 72 of 2022 dated 05.02.2022 under Sections 21(c)/29 of the NDPS Act. And In the matter of : Faruk Sardar. ……Petitioner. Mr. Md. G. N. Imrohi Mr. Partha Sarathi Sen .....for the Petitioner. Mr. Gouranga Kr. Das, Ld. APP Mr. Bankim Pal ……for the State. Learned advocate appearing for the petitioner submits that the petitioner was earlier released on bail but subsequently because of non-appearance, warrant of arrest was issued and the petitioner thereafter was arrested. Learned advocate appearing for the State submits that another accused is still absconding and the quantum of seizure is of commercial quantity. Petitioner was granted bail as there is no possibility of the trial being taken to its logical conclusion. Petitioner misused such liberty. As such Section 37 of the NDPS Act creates rigors for bail to be granted in case of offences relating to commercial quantity of contraband being seized. Petitioner having misused his liberty, I am not inclined to release the petitioner bail. 2 Accordingly, CRM (NDPS) 1405 of 2026 is dismissed. The Sub-inspector of Police who prepared the report is present in Court with a fresh report. Let the same be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
