It is also submitted that out of the 18 witnesses cited in the charge- sheet, only eight witnesses have been examined. Learned advocate, therefore, prays that the petitioner may be released on bail as there is no possibility of the trial being concluded in the near future. Learned advocate for the defacto-complainant is present and opposes the prayer for bail. 2 Learned advocate for the State has produced the case diary as well as the report. Having considered that prima facie there are materials to suggest and according to the evidence of the victim, before the learned trial court, the petitioner having taken the law in his own hand, I am not inclined to enlarge the petitioner on bail.
