Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 9 months and out of 29 witnesses cited by the prosecution, till date only 6 witnesses have been examined. Learned advocate for the petitioner has drawn the attention of the Court to the evidence of PW-3 being the father of the deceased which reflects that the witness heard from his son when a police personnel asked him regarding the assailant and his son could not throw any light as to who was the assailant. Emphasizing on such fact, learned advocate submits that petitioner’s implication therefore is without any substance and on conjecture and surmises. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are CCTV footages to the effect which shows that the present 2 petitioner was fleeing away after commission of the alleged offence. Petitioner was also identified in the T.I. Parade. Further, pursuant to the leading statement of the present petitioner, knife has been recovered. Having considered the manner in which the deceased was murdered and the prosecution has collected certain chain of materials, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. Mr. Gouranga Kumar Das, learned APP along with Mr. Amartya Mohan Bhattacharyya, learned advocate was directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities. The application for bail, being CRM (M) 2863 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
