2.
Learned counsel for the petitioner submits that the competent Tahsildar/Nayab Tahsildar has already passed the order dated 27.06.2025 directing eviction of the private respondent from the petitioner's land. However, despite the lapse of considerable time, the said order has not been implemented by the concerned authorities. It is further submitted that the petitioner has also submitted an appropriate representation before the concerned Tahsildar seeking execution of the aforesaid order, but no action has been taken thereon.
3
3. I have heard learned counsel for the petitioner and perused the material available on record.
4. Considering the facts and circumstances of the case, it appears that the petitioner has already approached the concerned Tahsildar by submitting a representation in the last week of June, 2026 seeking implementation of the order dated 27.06.2025. Since the said representation has been filed only recently, this Court is of the view that the petitioner ought to have waited for a reasonable period before invoking the extraordinary jurisdiction of this Court.
5. Accordingly, without expressing any opinion on the merits of the case, the concerned Tahsildar is directed to consider and decide the petitioner's pending representation/application for execution of the
order dated 27.06.2025 expeditiously, strictly in accordance with law.
6. With the aforesaid observations and directions, the writ petition stands disposed of.
7. It is made clear that this Court has not expressed any opinion on the merits of the case, and the competent authority shall consider the matter independently in accordance with law, without being influenced by any observation made in this order. Sd/- Sd/-
