Ramkunwar S/o Kunjiram, Aged About 40 Years, R/o Sarsena, Police Station Halena, District Bharatpur (Raj.) (At Present Accused Petitioner Is Confined In Central Jail Bharatpur). 2. Narendra S/o Naharsingh, Aged About 42 Years, R/o Sarsena, Police Station Halena, District Bharatpur (Raj.) (At Present Accused Petitioner Is Confined In Central Jail Bharatpur). ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Ms. Savita Nathawat For Respondent(s) : Mr. Vivek Sharma, PP Mr. Dinesh Kumar Pathak HON'BLE MR. JUSTICE SANDEEP TANEJA Order 26/02/2026 1. The instant bail application has been filed by the accused-petitioners, under Section 483 of B.N.S.S. in connection with FIR No.173/2025 registered at Police Station Halena, District Bharatpur for the offence(s) punishable under Section(s) 115(2), 126(2), 118(2), 110, 352 & 3(5) of BNS. 2. Learned counsel for the petitioners submits that the accused- petitioners have been falsely implicated in this case and they have nothing to do with the alleged offences. Learned counsel further submits that as per FIR, the allegation of causing grievous injury is specifically attributed to Deepak and Luv Kumar, however, they [2026:RJ-JP:8930] (2 of 3) [CRLMB-1865/2026] have not been charge-sheeted by the Investigating Agency and as per the injury report, none of the injuries are dangerous to life. Learned counsel also submits that petitioners are in custody since 29.12.2025, no recovery is required to be made from them; charge-sheet has been filed and trial of the case will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioner in custody and therefore, prays that petitioners may be enlarged on bail. 3. Learned Public Prosecutor and learned counsel for the complainant oppose the submissions made by learned counsel for the petitioners hereinabove. 4. Heard and perused the charge-sheet and material available on record. 5. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by the learned counsel for both the parties, the fact that none of the injuries are dangerous to life, charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 6. Therefore, this bail application is allowed and accused-petitioners, namely Ramkunwar S/o Kunjiram and Narendra S/o Naharsingh, are ordered to be released on bail, provided each of them furnish a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the following conditions:- [2026:RJ-JP:8930] (3 of 3) [CRLMB-1865/2026] (i) The accused-petitioners shall not tamper with evidence or influence the witness in any manner. (ii) The accused-petitioners shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law. (iii) The accused-petitioners shall attend the hearing of the trial Court on the date fixed by the trial Court or as and when asked to appear before the trial Court. (iv) In case of violation of any of the above conditions, the bail granted to the accused-petitioners shall be liable to be cancelled. (SANDEEP TANEJA),J AVINASH GULERIA /41
