JUSTICE R DEVDAS ORAL ORDER At Annexure ‘A’ is the impugned communication dated 07.11.2024 made by respondent No.3-Assistant Director of Land Records to respondent No.2-Deputy Director of Land Records for appropriate orders to rectify the Village Map. 2. The sum and substance of the communication is that in the Village Map or the Survey Records there appears to be a tank (katte) in the lands belonging to the petitioner. However, on physical verification it is found that there is no tank (katte) found in the land belonging to the petitioner. The Assistant Director of Land Records therefore requested the Deputy Director of Land Records for appropriate orders to make corrections in the Village - 4 - HC-KAR NC: 2026:KHC:19421 WP No. 25952 of 2025 Map/survey records to remove the katte which is found in the lands belonging to the petitioner. 3. When admittedly the respondent No.6-Bettakotte Grama Panchayath has invested huge sums of money to construct the water tank as found in the photographs at Annexure ‘H’ series combined with the fact that there is no tank (katte) found in the lands belonging to the petitioner, no prejudice will be caused either to respondent No.6- Grama Panchayath or respondent No.1-State if the necessary corrections are carried out in the Village Map or Survey Records. 4. In that view of the matter, the writ petition stands disposed of with a direction to respondent No.2-Deputy Director of Land Records to make necessary corrections in the Village Map or Survey Records to remove the katte as found in the lands belonging to the petitioner. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of the order in order to enable the - 5 - HC-KAR NC: 2026:KHC:19421 WP No. 25952 of 2025 Assistant Director of Land Records to proceed with the phodi proceedings of the petitioner.
