Sahana Sarkar Mr. Sayak Majumder …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon learned Civil Judge (Sr. Division), 1st Court at Barasat to dispose of Title Suit No. 400 of 2023 expeditiously. From the order-sheets appended to this application this Court finds that September 23, 2026 has been fixed for acceptance of the show-cause filed by the defendant. Learned advocate appearing for the petitioners submits that the written objection to the injunction application has not yet been filed. He further submits that the written statement has also not been filed. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned 2 advocate representing the opposite party before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioner, CO 1556 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court at Barasat to take up the matter for acceptance of the show- cause on the next date fixed, i.e., on September 23, 2026 and to decide the said issue in accordance with law. The learned trial judge is requested to make an endeavour to dispose of the pending application as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory applications, the learned trial judge shall make an endeavour to to dispose of Title Suit No. 400 of 2023 as expeditiously as possible. (Hiranmay Bhattacharyya, J.)
