1. Affidavit-of-service filed on behalf of the petitioners is taken on record.
2. It appears from the submission made on behalf of the petitioners that private respondents are obstructing the petitioners from enjoying peaceful possession of the land in question which prompted the petitioners to approach this Court with the present writ petition seeking direction upon the concerned police authority to take steps.
3. However, submission made on behalf of the petitioners is disputed by the learned advocate representing the private respondents. It is submitted that private respondents have right to cultivate the said land in question.
4. State respondents are represented by learned advocates.
5. Having considered the respective submissions made on behalf of the parties, it appears that the issue involved in this writ petition is civil in nature
[2] requiring the petitioners to approach Civil Court in pursuit of remedy.
6. Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.
7. Writ petition stands dismissed.
